Gregorio "Greg" A. Estevane, P.I.: J.D. has conducted some of his first interviews on homicide cases in the early 80's as a young criminal investigator. Subsequently, in the civil arena, Mr. Estevane has taken over a thousand statements in all manner of civil and other litigation in high stakes litigation cases. Cases are often won and lost on the quality of one or several statements given by witnesses.
Statements you desire are formatted in: Tape Recorded; DAT Recorded; Video Taped; In Person, Handwritten and signed by the witness/party; paraphrased; using the Internet; or other methods.
We assume that every statement we take may require our testimony in a Court of Law, under penalty of perjury, whether for impeachment, foundational, availability or other reasons.
In the process of taking these statements we extract information (as requested) that relates to character evidence, reputation, bias or non-bias, admissions, state of mind while paying special attention to hearsay, opinions, assumptions, privileges, expertise and other areas.
As well you should always know something about your witness such as their vision, hearing, thought ability, previous experiences that may traumatize and bias their current views, medication, drugs, alcohol, mental and stress conditions both when observing the event that they may testify to and when they are giving their statement, post incident.
Experts on both sides need to divulge as much data as to the basis of their expertise, writings, experience, teaching so that they may be properly bolstered or destroyed once their relied upon expertise has been verified or unverified.
In addition highly detailed information as to Who, What, When, Where, Why and How requires the quality of the question and answers to flow in a manner like a verbal-video tape of the event that captures every second of relevant detail.
A picture is worth a thousand words so the interview should be extremely in depth, as it is words that we use to describe the events (pictures) that we see, hear, touch, taste and sense while always factoring in the aforementioned legal considerations.
